With increasingly complex family, estate and company affairs in operation, it is imperative that a Trust's Trustees are properly protected. Most family Trustees accept the responsibility to manage a Trust's affairs, usually out of a sense of duty to the family and with the very best of intentions. To suddenly find themselves being sued by other family members, or indeed any outside third party, for an alleged Breach of Duty or Trust over the management of the Trust's affairs can prove both extremely expensive and hurtful.
With many years of experience Lycetts offers a new Family Trust Liability policy, exclusive to us and designed to protect all those involved.
Operating in a similar way to a standard Directors' & Officers policy, this new Family Trust Liability policy is tailored to meet the specific and multiple requirements of family Trusts of all types, as well as individual private clients or those with just a single property.
Drawn up in the name of the 'Trustees of a Named Trust', our Family Trust Liability policy protects the personal assets of the Trustees as well as providing for defence costs in any legal disputes and provision for damages awarded against Trustees where the Trust may be reimbursed accordingly. Importantly, cases of Insured versus Insured, such as where a beneficiary who is also a Trustee sues a fellow Trustee, are also covered.
In addition we can provide an Expert Advice extension for retired professionals or the family friend receiving a small remuneration for their services, even if it's just considered to be expenses.
